1. General Provisions
These Terms and Conditions govern the rights and obligations between CRAFT SPIRITS
d.o.o., Malca 68, 34334 Kaptol, OIB: 54341015731 (hereinafter: “Seller”) and users of the
webshop www.castrum.hr.
By using the website and concluding a sales contract, the user agrees to these Terms and
Conditions.

2. Products and Prices
All prices are expressed in euros (EUR) and include VAT, unless otherwise stated. The Seller
reserves the right to change prices without prior notice.

3. Ordering Process
By selecting products and completing the order form, the customer submits a binding
purchase offer. Upon receipt of the order, the Seller sends an offer and/or invoice to the
customer via email.
The sales contract is considered concluded at the moment the customer completes payment.

4. Payment Methods
Payment is made via bank transfer. Online card payments are currently not available.

5. Delivery
Delivery is carried out via courier service DPD or personal pickup at the distillery, according
to the customer’s choice during checkout.
Delivery times depend on product availability and delivery location.

6. Complaints and Returns

Right of Withdrawal from a Distance Contract

The consumer has the right to withdraw from a distance contract without stating any reason within 14 (fourteen) days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes possession of the goods, or from the date of conclusion of the contract in the case of a service contract.

To exercise the right of withdrawal, the consumer may use the “Contract Withdrawal” function available on the Merchant’s website (within the user account under the “My Orders” section for registered users, or via a dedicated withdrawal form for non-registered users). By using this functionality, the consumer submits a withdrawal statement electronically. The Merchant shall promptly provide the consumer with an acknowledgment of receipt of the withdrawal statement on a durable medium (by email), including the exact date and time of receipt.

The consumer may also exercise the right of withdrawal in another manner (e.g. by completing the standard withdrawal form or by sending an unequivocal statement). However, the Merchant recommends using the functionality described in the previous paragraph to ensure faster and simpler processing.

The right of withdrawal does not apply in the cases prescribed by Article 79(3) of the Croatian Consumer Protection Act, in particular with regard to:

  • goods made to the consumer’s specifications or clearly personalized;
  • goods that are liable to deteriorate or expire rapidly;
  • sealed goods which are not suitable for return due to health protection or hygiene reasons if they have been unsealed after delivery;
  • goods which, after delivery, have become inseparably mixed with other items by their nature; and
  • other cases provided for by applicable law.

If the consumer exercises the right of withdrawal, they must return the goods to the Merchant without undue delay and no later than 14 (fourteen) days from the day on which they informed the Merchant of their decision to withdraw from the contract. The direct costs of returning the goods shall be borne by the consumer, unless the Merchant has agreed to bear those costs or has failed to inform the consumer in advance that such costs are to be borne by the consumer.

The Merchant shall reimburse all payments received from the consumer, including the costs of delivery (except for any additional costs resulting from the consumer’s choice of a type of delivery other than the least expensive standard delivery offered by the Merchant), without undue delay and no later than 14 (fourteen) days from the day on which the Merchant received the consumer’s decision to withdraw from the contract. The Merchant may withhold reimbursement until the goods have been received or until the consumer has supplied evidence of having sent back the goods, whichever occurs first.

The consumer shall be liable for any diminished value of the goods resulting from handling the goods, except where such handling was necessary to establish the nature, characteristics, and functioning of the goods.

7. Product Defects
The Seller is liable for material defects in accordance with applicable laws of the Republic of
Croatia.

8. Liability
The Seller shall not be liable for damages arising from improper use of products.

9. Intellectual Property
All content on the website (texts, images, logos) is the property of the Seller and may not be
used without prior consent.

10. Dispute Resolution
The parties will attempt to resolve disputes amicably. In case of court proceedings, the court
with jurisdiction over the Seller’s registered office shall have authority.
Consumers have the right to use alternative dispute resolution mechanisms through authorized
bodies.

11. Amendments
The Seller reserves the right to amend these Terms and Conditions at any time. Changes take
effect upon publication on the website.
